All rentals are subject to the following terms and conditions. Please review thoroughly before placing your order. “We” or “us”means gpsxmrentals.com, and/or its corporate parent; “you” or “your” refers to the renter. START DATE. The desired starting date submitted with your rental order should be the latest date you need the gear to depart on your trip. The gear will be shipped to arrive at least one day before your start date. Because of shipping times and limited weekend delivery options, the effective “Start Date” for your rental must fall on a Tuesday – Friday. If you need gear for a Saturday – Monday departure, use the preceding Friday as your Start Date. DROPOFF DATE. The date the gear must be cleaned, re-boxed and dropped off for shipment to any UPS office or authorized center such as Mail Boxes, Etc. RENTAL LENGTH. The time-options for rental of gear and descriptions include: - Weekend: Available only for a Friday “Start Date”, with the rented gear normally being delivered to you on Thursday. The immediately following Monday is your “Drop Off Date”.
- 7-Day: Can be any Start Date of Tuesday – Friday, with the latest Drop Off Date being one week from your Start Date.
- Example: If your Start Date is on Wednesday May 21, the gear will be delivered to you usually by the day before (Tuesday, May 20), and will be due at a shipping center not later than the following Wednesday, May 28.
- 14-Day: Can be any Start Date of Tuesday – Friday, with the latest Drop Off Date being two weeks from your Start Date.
- Example: If your Start Date is on Friday, May 23,the gear will be delivered to you usually by the day before (Thursday, May 22), and will be due at a shipping center not later than the second following Friday (June 6).
LATE CHARGES. If you do not deliver the gear for return shipment by your required Dropoff Date, late fees will be assessed as follows, up to a maximum of the Designated Purchase Price (see below) for the gear: - Weekend Rental – 40% of the total original rental fee per day late
- 7-Day Rental – 20% of the total original rental fee per day late
- 14-Day Rental – 10% of the total original rental fee per day late
DEPOSITS. To help protect us against loss, damages or theft of the gear, we require a deposit approximating the retail value of the gear. This amount will be reserved against your credit card, but will be released upon return of the gear in the same condition as when delivered, normal wear and tear excepted. Any charges or reimbursement costs due us beyond the deposit amount will also be charged to your credit card. DESIGNATED PURCHASE PRICE. We do not offer new product for sale on a retail basis as part of our primary business, except for accessories and incidental consumables. If you wish to buy an item you have rented, or become responsible for its replacement cost due to loss or damage, the Designated Purchase Price for such item shall be equal to the deposit amount associated with that item. If purchased, any rental fees due under the current transaction will be waived, but shipping and taxes will be charged in addition to the deposit amount. CLEANING. We will clean and disinfect all gear before delivery to you. You must return the gear to us free of mud and heavy dirt. The gear must be dry before shipping to us to avoid mildew or mold, the presence of which upon return to us will result in charges against your deposit for repair or replacement. DAMAGES. Even though you are renting the gear, you will treat it as if you own it. Our rental rate assumes a limited amount of wear which may occur with a rental use. However, rips, tears, excessive dirt or stains, mildew, or missing parts noted upon return will result in charges against your deposit for repair or replacement. As an alternative, you may purchase any item you damage as set forth under “Designated Purchase Price” above. LOSS/THEFT/NON-RETURN. You are responsible for the gear at all times between delivery and return to our facility. We provide no insurance against loss once delivered to your address. Any gear not dropped off for return to us within one week of the scheduled Drop Off Date will be assumed lost and your credit card will be charged for the Designated Purchase Price of each gear item, plus shipping and taxes if applicable. SHIPPING. Shipping is based our using low-cost options from our facility in Arizona to your designated point of delivery, and the return to our facility from that area. We prepay the to/from shipping, and the cost is reflected in the transaction amount that will be charged to your credit card. A prepaid, prepared self-addressed shipping label will be provided in the box with the gear delivered to you. You may use the same box to pack and return the gear to us. After cleaning and drying the gear, simply seal the box (carefully and fully), affix the label, and drop off at an authorized UPS shipping facility. You should obtain a receipt from the shipping facility reflecting the date you dropped it off, as well as insurance to cover the gear in transit back to us. A signature is required for delivery or pickup of the gear. Any refused or returned deliveries will be processed as a completed rental transaction, with the full rental fees assessed to the renter. Every effort is made to deliver the gear to your designated valid address not later than the day before your Start Date. If your order is timely placed and accepted at least 48 hours prior to our required ship date, we guarantee delivery of the gear to your designated valid address by noon of your Start Date, or any rental fees up to the "weekend" rate for the gear is waived. SALES/USE TAXES. Gear shipped to Arizona addresses, or as required elsewhere, that is subject to applicable transaction (sales) taxes will be added to the rental fee. Any taxes not charged to you by us that may be due in your tax jurisdiction as “Use Taxes” are solely your responsibility to report and pay. LIABILITY. You recognize and acknowledge that outdoor activities such as hiking and backpacking can be inherently dangerous and unpredictable. We are not responsible for any accidents that may arise from your activity or use of our gear, and you hereby agree to indemnify us from any claims, charges or costs arising from your use of our gear or any related activities. While we will provide you gear as described in our product descriptions, we do not expressly or otherwise guarantee or warrant the gear for any specific performance or purpose other than as it is described. If any item of gear malfunctions or otherwise fails to perform its described functions, our maximum liability to you is the rental value paid for the item. RESERVATION REQUIREMENTS. If our inventory is not previously committed to other customers, we can generally ship your order within 2 business days of its receipt. Delivery via ground shipment typically requires 3 to 5 business days from the ship date. Your order should therefore be placed at least 5 - 7 business days in advance of your Start Date -just to get it there - and that's pushing it. Reserve as far ahead as possible to ensure best selection of gear. At certain times, inventory may not be available for your desired Start Date. You will be contacted if your Order cannot be accepted due to prior inventory commitments or other reasons. Alternative products or dates or can be discussed with you at that time. Rush shipments may be available at additional shipping and handling costs; contact us for special requirements. CANCELLATIONS. If you cancel your order in writing more than two weeks ahead of the scheduled shipping date, no fees will be charged. If less than two weeks, but prior to the day of shipment, a $10.00 processing fee will be charged to your card. The preceding notwithstanding, additional financial commitments may be required for large orders or orders for which we make special inventory arrangements; you will be notified in advance if we deem such commitments appropriate. Cancellation of an order is not an option once the gear has left our facility. VENUE. Any judicial actions arising from our rental of gear to you shall be held in the appropriate court in Maricopa County, Arizona. |
